SBE Postpones Discussion of Del. Onzlee Ware Campaign Finances

FOIA2In a phone call yesterday and confirmation today David Allen, Campaign Finance Manager with the State Board of Elections in Richmond said the issues surrounding Delegate Onzlee Ware’s campaign expenditures is “not going away.” Any statements to the contrary are in error. Allen is aware of the distortions by a blogger.

I suggested to Allen it would be a real boon to open government if the SBE meetings were webcast. The Virginia General Assembly and Senate both stream live when in session. Allen said, “In regards to your suggestion that the meetings be webcast, I think that is a very good idea and will look into it.”

If the meetings are webcast even with a delay this would be a win for open government. Virginia may get better grades at evaluation time.

The State Board of Elections Agenda is full for Friday, July 10. Numerous topics that came up during the June Primary have filled the agenda. The date of the next Board meeting will be determined at Friday’s meeting. Friday’s agenda is attached. Minutes of SBE meetings appear on the Commonwealth’s website a few days following the meetings.

As the so-called distorting blogger, I am here to debate, Ms. Garner.

What have I distorted? Here are Mr. Allen’s written statements:

Good morning, Mr. Allen. Thank you very much for the CD.

I have a few questions:

1. Why have you included filing documents of “R. Lee Ware, Jr.” of the 65th district in your investigation of Onzlee Ware of the 11th District (they were included in our FOIA request)? The pair jokingly refer to each as cousins but there is no relation.

[David Allen (SBE)] This was an oversight on my part. When my staff pulled and scanned the documents in Delegate Onzlee Ware’s file, someone must have inadvertently misfiled some of R. Lee Ware, Jr.’s documents in the wrong folder.

2. Sources close to Delegate Ware’s office have indicated that Mr. Ware’s amendments were accepted and no additional issues found. Is this correct?

[David Allen (SBE)] There were not any violations that pertained to § 24.2-947 et. Seq. Of the Code of Virginia.

3. Finally, SCH has been told that the alleged evidence regarding Mr. Ware’s filing documents will not be presented to the Board on Friday as previously reported. Is this correct?

[David Allen (SBE)] That is correct. Del. Ware will not be on the agenda for the July 10, 2009 Board meeting.

No distortion.

First, Mr. Allen told Onzlee Ware and his representative Mr. Piper (a former SBE member) that they would appear on Friday.

Then, he told them they wouldn’t.

Here is what he told us just a few days ago:

I apologize for the delay in responding to your emails and voicemails. The complaint made against Delegate Ware is schedule to go before the State Board of Elections for their review at the July meeting. The meetings are open to the public and public comment is allowed. The date, time, location and agenda for the meeting can be found on the Commonwealth’s calendar:

Mr. Allen:

On or about June 5, 2009, a few weeks after receiving the complaint from Mr. Powell and investigating it, you told The Roanoke Times: “as far as I can tell, I don’t see anything so far as a violation of the state code.” Now, your comments appear on the front page of The Roanoke Times indicating that Mr. Ware is being referred to your Board for further investigation. How do these two situations jive? How could a matter about which you were so dismissive earlier become a scandal less than 20 days later?

Thanks for your cooperation. I have now emailed three times, phoned and faxed you my questions and/or request for information. I have yet to receive a confirmation that they were received, though my facsimile transmission report indicates that my facsimile was received at your fax number.

As you understand, yesterday, you were prompt enough to answer questions for The Roanoke Times regarding this matter . . . so prompt in fact that a version of the events surrounding your investigation of Mr. Ware appeared today.

I would simply appreciate the same courtesy.
